Welcome to Sky Seekers (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website, services, and participation in our activities, including but not limited to skydiving, paragliding, and other adventure experiences offered by Sky Seekers, located at Residence #1 072, Retail #012, Abu Bakar Siddique Road, Al-Muteena, Deira, Dubai, U.A.E. By accessing our website, booking our services, or participating in our activities, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

  1. Services and Activities

Sky Seekers provides adventure activities, including skydiving, paragliding, and related experiences. All activities are subject to availability, weather conditions, and safety requirements. We reserve the right to cancel or reschedule activities at our discretion, with notice provided to you.

  1. Eligibility and Health Requirements

  • Participants must be at least 18 years old or accompanied by a legal guardian.

  • You must disclose any medical conditions, physical limitations, or other relevant health information prior to participation. Certain activities may require a medical clearance.

  • Pregnant individuals or those with heart conditions, back or neck issues, or other serious medical conditions may be prohibited from participating for safety reasons.

  • You must follow all safety instructions and guidelines provided by our staff.

  1. Bookings and Payments

  • Bookings can be made through our website, by phone (+97142559014), email (info@skyseekers.ae), or in person during business hours (9:30 AM to 10:00 PM daily).

  • Full payment is required at the time of booking unless otherwise specified.

  • Prices are subject to change without notice. All fees are quoted in UAE Dirham (AED) and include applicable taxes unless stated otherwise.

  • Payments are processed securely through our third-party payment providers. You agree to provide accurate payment information.

  1. Cancellations and Refunds

  • Customer Cancellations: Cancellations made at least 48 hours prior to the scheduled activity may be eligible for a full refund or rescheduling, subject to a processing fee. Cancellations within 48 hours are non-refundable.

  • Our Cancellations: If we cancel an activity due to weather, safety concerns, or other unforeseen circumstances, we will offer a full refund or the option to reschedule.

  • Refunds, if approved, will be processed within 7-10 business days to the original payment method.

  1. Assumption of Risk and Liability

  • Adventure activities involve inherent risks, including but not limited to injury, death, or property damage. By participating, you acknowledge and accept these risks.

  • You agree to release, waive, and hold harmless Sky Seekers, its employees, agents, and affiliates from any liability for loss, damage, injury, or death arising from your participation, except in cases of gross negligence or willful misconduct.

  • You are responsible for any damage to equipment or property caused by your negligence or failure to follow instructions.

  1. Media and Photography

  • We may take photos or videos during activities for safety, training, or promotional purposes. By participating, you grant Sky Seekers permission to use such media in marketing materials unless you explicitly opt out in writing prior to the activity.

  • You may purchase photos or videos taken during your activity, subject to availability.

  1. Conduct and Safety

  • You must comply with all instructions, rules, and safety protocols provided by our staff. Failure to do so may result in removal from the activity without a refund.

  • We reserve the right to refuse service to anyone who appears intoxicated, disruptive, or otherwise unfit to participate.

  • Smoking, alcohol, and illegal substances are strictly prohibited during activities.

  1. Intellectual Property

  • All content on our website, including logos, text, images, and designs, is the property of Sky Seekers or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without written permission.

  1. Privacy

  • Your personal information is handled in accordance with our Privacy Policy, available on our website or upon request. By using our services, you consent to the collection and use of your information as described therein.

  1. Third-Party Services

  • Our website or services may involve third-party providers (e.g., payment processors or booking platforms). We are not responsible for the actions, policies, or performance of these third parties.

  1. Force Majeure

  • We are not liable for delays, cancellations, or failures to perform due to events beyond our control, including but not limited to natural disasters, government actions, or pandemics.

  1. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai.

  • Any disputes arising from these Terms or your use of our services will be resolved through negotiation. If unresolved, disputes will be subject to the exclusive jurisdiction of the courts in Dubai, U.A.E.

  1. Changes to These Terms

  • We may update these Terms at our discretion. Changes will be posted on our website with an updated effective date. Your continued use of our services constitutes acceptance of the updated Terms.
